Terms

These Terms apply when you create an account, build a site, upload content or otherwise use ItsySite. By using the service, you agree to them.

Accounts

You must be at least 18 to create an account. Provide accurate account information, keep your sign-in details secure and take responsibility for activity on your account.

Deleting your account closes it and takes every site offline immediately, even if a paid period remains. Active subscriptions are cancelled, and your information is deleted as explained on the Privacy page.

Plans, renewals and cancellation

Plans renew automatically at the price and interval shown at checkout until cancelled. Upgrades apply immediately; downgrades and billing-interval changes apply at the next renewal. If payment fails, your plan may be suspended or end. Cancellation takes effect on your subscription end date, and you retain your plan benefits until then. When your plan ends, all sites are taken offline. If you downgrade, sites exceeding the new allowance are taken offline and unavailable plan features stop working. Lemon Squeezy handles payment, tax, receipts, renewal reminders and payment recovery as our merchant of record.

Refunds

Refunds are available on request within 14 days of your first payment, within 48 hours of a monthly renewal, or within 14 days of an annual renewal. Annual-renewal refunds may be reduced proportionately to reflect use after renewal. If we refund a subscription payment, the related paid access ends when the refund is issued. Refunds are not issued when we close an account for a serious or repeated breach of these Terms, unless required by law.

Service availability

We do not guarantee uninterrupted or error-free access. ItsySite may occasionally be unavailable because of maintenance, technical problems or circumstances outside our reasonable control.

Fair use

Plans are intended for ordinary website traffic. If a site's traffic or resource use materially affects our costs or the service, we may contact you to agree suitable pricing or another arrangement. We will not change your price without your agreement. Where necessary to protect the service, we may temporarily limit traffic while we contact you.

Ending the service

If we discontinue ItsySite, we will give reasonable notice where possible, allow time to copy your content and refund any unused prepaid period.

Your content

You keep ownership of your content. You give ItsySite permission to host, copy, resize and display it only as needed to operate the service. You must have the rights and permissions needed to publish everything you submit.

Personal information in your content

Where your site content contains personal information about other people and data-protection law treats you as its controller, ItsySite acts as your processor. You are responsible for having a lawful basis and providing any required privacy information. These Terms, your use of the service and your settings instruct us to host, copy, resize, secure, back up and display that information only to provide the service. This may include names, contact details, photographs and event information.

We process that information only on your documented instructions or where law requires, keep it confidential and secure, and use the service providers identified on the Privacy page as subprocessors under equivalent obligations. We will reasonably assist with people's data rights, security incidents and impact assessments, provide information needed to show compliance, allow reasonable audits, and delete or return the information when the service ends, subject to legal retention and temporary recovery copies. We will give reasonable notice of material subprocessor changes.

Our service

The ItsySite name, branding, website builder and software belong to us. These Terms allow you to use the service; they do not transfer ownership of it.

Domains

You are responsible for registering, renewing and correctly configuring any custom domain. ItsySite addresses remain under our control and are provided for use with the service. They may be released after you change them or permanently delete the relevant site or account.

Prohibited content and use

Do not use ItsySite for:

• Illegal content or activity.
• Pornographic, sexually explicit, adult or NSFW content or services.
• Hateful, threatening or harassing content, doxxing, graphic violence, or content that encourages violence or self-harm.
• Scams, spam, malware or deceptive impersonation.
• Illegal goods or services, or the sale or promotion of controlled drugs, weapons, tobacco, nicotine or other dangerous or unlawfully regulated products.
• The promotion or facilitation of gambling.
• Content that infringes copyright, trade marks, privacy or other rights.

Links and off-platform activity

Except for lawful adult content or services, the prohibited content rules also apply to directly linked destinations. Redirects or intermediary pages must not be used to evade these rules.

Enforcement

We may investigate reports and take proportionate action where we reasonably believe content or activity breaches these Terms, creates a serious risk of harm to people, ItsySite or its reputation, or must be addressed to comply with law. This may include removing content, taking a site offline, restricting features, suspending or closing an account, preserving evidence or reporting material. We consider context and severity and may act immediately where there is a serious risk of harm.

Sanctions and restricted locations

You must not use ItsySite if you are subject to sanctions imposed by the United Kingdom, or owned or controlled by someone who is. You must not use ItsySite where doing so would cause us or our service providers to breach sanctions or export-control laws that apply to them. Payments and paid plans are unavailable where Lemon Squeezy does not support purchases. We may restrict, suspend or end access where reasonably necessary to comply with these requirements.

Liability

To the extent permitted by law, we are not responsible for losses caused by events outside our reasonable control, content you publish, your use of ItsySite in breach of these Terms, or custom-domain and DNS matters outside our control. If you use ItsySite for business, we are not liable for indirect or consequential loss, or loss of profit, revenue, business, goodwill or data. Our total liability to a business user is limited to the greater of £100 or the amount paid for ItsySite in the 12 months before the event giving rise to the claim.

Changes to these Terms

We may update these Terms for legal, security or service-related reasons. We will give reasonable advance notice of material changes. If you do not agree, you may stop using ItsySite and cancel any paid plan before the change takes effect.

Governing law

These Terms are governed by the laws of England and Wales.
